Please read these Terms of Service carefully before placing an order or commission with Kiss My Glass. By contacting us to place an order, you agree to these terms. If you have questions, contact us before ordering.

1. About Kiss My Glass

Kiss My Glass is a sole-proprietor custom glass art business operated by Michael Nash in Canada, also operating under the brand name Nashterpiece. We create handcrafted, one-of-a-kind glass art pieces including rolling trays, portrait commissions, and other custom glass work.

This website (kissmyglass / nashterpiece) is an informational and commission-inquiry website. It is not an automated e-commerce store. All purchases and commissions are arranged directly with Michael Nash through Instagram or Facebook.

2. Use of This Website

This website is provided for informational purposes and to allow you to submit commission inquiries. You may use this website for lawful personal purposes only. You agree not to:

  • Copy, reproduce, or distribute the content, artwork, or photography on this website without written permission
  • Use this website in any way that may damage, disable, or impair its availability
  • Attempt to gain unauthorized access to any part of this website or its related systems
  • Use the content on this website for commercial purposes without our prior written consent

3. Commission Inquiries

Submitting a commission inquiry through this website or through Instagram or Facebook does not constitute a binding order or contract. A commission becomes a binding agreement only when:

  • Michael Nash has confirmed he accepts your commission in writing, and
  • You have approved the proposed design, and
  • A deposit has been paid as agreed

Until all three conditions are met, no obligation exists on either side.

4. Custom Commission Terms

4a. Deposits

A non-refundable deposit is required before production begins on any custom commission. The deposit amount will be confirmed by Michael Nash at the time of your order. Typically, a deposit of 50% of the agreed price is required upfront, with the remaining balance due before the finished piece is shipped or picked up.

The deposit secures your place in the production queue and covers the cost of materials purchased specifically for your commission. It is non-refundable if you cancel your order after production has begun.

4b. Design Approval

Before production begins, Michael Nash will present a design concept for your approval. You may request reasonable revisions at this stage at no additional charge. Once you have approved the design in writing (by message), production begins and significant design changes may incur additional charges or extend the timeline.

4c. Timelines

Estimated production timelines are provided in good faith but are not guaranteed. Timelines may vary based on complexity, material availability, and current workload. If you have a firm deadline, you must communicate this before placing your deposit. Michael Nash will confirm whether your deadline is achievable.

4d. Pricing

All pricing is quoted in Canadian dollars unless otherwise agreed in writing. Prices quoted are for the piece only and do not include applicable taxes or shipping costs unless specifically stated. Taxes will be applied in accordance with applicable Canadian federal and provincial tax legislation.

4e. Final Payment

The remaining balance is due before the finished piece is shipped or transferred to you. Pieces will not be shipped until payment is received in full.

4f. Cancellation by Customer

If you cancel a commission:

  • Before design approval and deposit: No charge. No obligation.
  • After deposit paid but before production begins: Your deposit is forfeited. No further charges apply.
  • After production has begun: Your deposit is forfeited. Depending on how far along the work is, additional charges may apply to cover materials and labour already committed. Michael Nash will communicate this clearly before any additional charges are incurred.

4g. Cancellation by Kiss My Glass

In the unlikely event that Kiss My Glass must cancel an accepted commission (for example, due to illness, material unavailability, or circumstances beyond our control), you will receive a full refund of any deposit paid. We will communicate with you as early as possible.

5. Ready-Made Pieces

Ready-made pieces offered for sale are one-of-a-kind handcrafted objects. Due to the handmade nature of each piece, minor variations in colour, texture, and finish from any photographs are normal and not considered defects.

Returns and exchanges for ready-made pieces are considered on a case-by-case basis. Contact Michael Nash directly if you have a concern about a piece you have received. Pieces damaged in transit will be handled as described in Section 6.

6. Shipping and Damage in Transit

All pieces are carefully packaged to protect them during shipping. Risk of loss and title for pieces pass to you upon delivery to the carrier.

If your piece arrives damaged, you must:

  • Contact Kiss My Glass within five (5) business days of receiving the package
  • Provide photographs of the damaged piece and the packaging
  • Retain all original packaging materials

We will work with you in good faith to resolve the situation, which may include filing a claim with the shipping carrier, repairing the piece, or producing a replacement where reasonably possible. Custom commissions are one-of-a-kind and an exact replacement may not always be possible.

7. Intellectual Property

All original glass artwork created by Michael Nash is the intellectual property of Kiss My Glass and Michael Nash. The sale of a physical piece does not transfer copyright or any other intellectual property rights.

Specifically, Kiss My Glass retains the right to:

  • Photograph and display any piece we make, including custom commissions, for portfolio, social media, and marketing purposes
  • Create similar works in the same style
  • Reproduce images of completed works for promotional use

If you have a specific privacy concern about your commission being shared publicly (for example, if it contains a personal image, name, or memorial), please advise us at the time of ordering and we will respect that request.

All written content, logos, branding, and design elements on this website are owned by or licensed to Kiss My Glass and may not be copied or reproduced without permission.

Placeholder images on this website sourced from Pexels are used under the Pexels License and are free for commercial use.

8. Accuracy of Information

We make reasonable efforts to keep the information on this website accurate and current. However, product availability, pricing, and timelines change. Nothing on this website constitutes a binding offer. All orders are subject to confirmation by Michael Nash.

Colours of glass pieces as photographed may vary from the actual piece due to differences in screen calibration, lighting, and the natural variations in handmade glass. This is not a defect.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Kiss My Glass and Michael Nash will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of this website or from any transaction with us.

Our total liability to you for any claim arising from a transaction will not exceed the amount you actually paid for the piece in question.

Nothing in these terms limits your rights under applicable consumer protection legislation in British Columbia, Alberta, or Canada, including rights under the BC Consumer Protection Act, the Alberta Consumer Protection Act, and any other applicable law that cannot be excluded or limited by agreement.

10. Consumer Protection

If you are a consumer resident in British Columbia, you have rights under the Business Practices and Consumer Protection Act (BC BPCPA). If you are a consumer resident in Alberta, you have rights under the Consumer Protection Act (Alberta). These rights are in addition to the terms described here and cannot be contracted out of.

This includes, but is not limited to, protections against deceptive practices, rights to accurate information before purchase, and rights relating to quality of goods.

11. Third-Party Platforms

This website links to Instagram and Facebook. Your interactions with those platforms are governed by their own terms of service. Kiss My Glass is not responsible for the terms, content, or practices of those platforms.

12. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of Canada and, as applicable, the Province of British Columbia or the Province of Alberta, depending on your province of residence and the location of our business operations.

Any dispute arising from these terms or from any transaction with Kiss My Glass will first be addressed through direct communication. We will make a genuine effort to resolve any concern you raise. If a dispute cannot be resolved through direct communication, it will be subject to the jurisdiction of the courts of the applicable province.

If you are a consumer in British Columbia, you may also access dispute resolution through the BC Civil Resolution Tribunal for small claims matters (civilresolutionbc.ca).

13. Changes to These Terms

Kiss My Glass reserves the right to update these Terms of Service at any time. The effective date at the top of this page will reflect when changes were last made. Changes do not apply retroactively to orders already in progress at the time of the change.

Continuing to use this website or placing an order after changes are posted constitutes acceptance of the updated terms.
